|
Documents Necessary to Obtain a Trust Bond:
- Completed and Signed Application
- Copy of the Trust
- List of all the assets within the Trust
- Names and Addresses of all the Beneficiaries of the Trust
**Please indicate on the bond application if the trust matter is Court-Supervised or Non-Court Supervised due to differences with bond form and premium rate.

May 1, 2008 — Bond Tips
|
Bond Tip #1 (Probate):
Before filing your Petition for Probate, if you are unsure if your client qualifies for a Probate bond, we strongly recommend that your client complete and sign a bond application and fax the following to our office for review and comment. This process will save your client and your office time and money should you discover that the proposed personal representative does not qualify for a bond.
Bond Tip #2 (Probate): If the bond amount exceeds $400,000.00, we strongly recommend you submit to our office along with the completed and signed application and/or bond the following paperwork in order to better assess the bond qualification of your client:
- Copy of the Petition along with Attachment 9
- Copy of the Will, if appropriate
- A breakdown of the assets within the Estate. Specifics on what type of assets are in the estate such as real property, CDs, stocks, cash, etc and where are they currently held
- For guardianship matters, a copy of the Proposed Investment Plan for the minor's assets. The surety needs to know that the funds will be properly handled and that the investment adviser/broker is adhering to the Prudent Investor Act.
Bond Tip #3 (Civil-Bonds with Collateral):
To assure the prompt issuance of a Civil Bond with collateral, we strongly recommend that your office or your client fax us a copy of the collateral paperwork for review and comment. This process will allow us to examine if any of the paperwork is missing signatures or information.
WE CANNOT RELEASE THE BOND UNTIL WE RECEIVE THE ORIGINAL 'WET INK' SIGNED AND NOTARIZED COLLATERAL PAPERWORK, COLLATERAL AND BOND PREMIUM.
